§ 15.08.010. Amendments.

  • A. There is adopted by the village for the purpose of prescribing regulations for the protection of the public health and safety of its inhabitants, that certain code known as the Uniform Code For The Abatement Of Dangerous Buildings of the International Conference of Building Officials, 1997 Edition, save and except such portions as are hereinafter deleted, modified or amended, as hereinafter set forth, and the same is adopted and incorporated as fully as if set out at length in this ordinance. From the date on which the ordinance is adopted, the provisions thereof shall be controlling within the limits of the village.

    B.

    The Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, is amended by deletion of Chapter 8 thereunder, in its entirety.

    C.

    The Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, is amended as to substitute the term "board of appeals" with the term "planning commission".

    D.

    The Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, is amended as to Section 403, to read as follows:

    1.

    The building shall be repaired, when ordered by the building official, by the building owner, in accordance with the current building code or other current code applicable to the type of substandard conditions requiring repair; or

    2.

    The building shall be demolished, when ordered by the building official, by the building owner; or

    The Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, is amended as to Section 70l, to read as follows:

    701.3 Failure to Commence Work.

    The building official may, in addition to any other remedy herein provided, cause the building to be repaired by the building owner to the extent necessary to correct the conditions which render the building dangerous as set forth in the notice and order; or, if the notice and order required demolition, to cause the building to be sold and demolished or demolished and the materials, rubble and debris there from removed and the lot cleaned. Any such demolition work shall be accomplished and the cost thereof paid and recovered in the manner hereinafter provided in this code. Any surplus realized from the sale of any such building, or from the demolition thereof, over and above the cost of demolition and of cleaning the lot, shall be paid over to the person or persons lawfully entitled thereto.
